The Regular Meeting of Council was called to order by Mr. Moran, President of Council, at 8:00 p.m. in the David J. Cook Council Chambers.

MAYOR'S REPORT:
Next Monday, June 30, an airport noise meeting will be held. The Mayor and Councilman Furry will attend.
The next Detroit Road Stakeholders' meeting will be held on July 1 at 8:30 a.m. at the Don Umerley Civic Center. City Architecture, represented by Paul Volpe and Alex Pesta, will present the workbooks they have been assembling. From this meeting, an action plan will be developed together with a magnitude budget. The Mayor noted that a great deal has been accomplished, but a great deal lies ahead. Anyone interested is welcome to attend. The Mayor added that the meeting will be over by 10:00 a.m. because many business owners need to return to their offices.
A complimentary letter has been received from David Harbarger, counsel for Dominion/East Ohio and First Energy/CEI, thanking the Law Director, the Council and the Administration for the professional manner in which the right-of-way ordinance was discussed and drafted.
An e-update was disseminated to inform residents that First Energy Transmission Forestry Department will perform helicopter inspections of CEI's transmission lines. This process will take place over the next week or so. As a result of that notification, a wonderful note was received from a resident thanking the City for its helpful and informative, yet brief, informational messages. She continues to say that all of her interactions with the City, from basement flooding and sewer line replacement to the parking of an RV to West Nile virus have been most satisfactory.
The Greek Festival, held over this last weekend, was very successful.
The Community Challenge forum, held last Wednesday and attended by approximately 50 residents, had an excellent presentation with honest and open dialogue. That discussion has provided some direction for future forums. The Mayor thanked everyone who participated on behalf of the City, Community Challenge and the Rocky River School District.
On Saturday, June 28, the Run for the Young will be held at Crocker Park. The Mayor noted that this event is sponsored by the Cleveland Clinic, but community organizations such as the Rocky River Recreation Center and Community Challenge are two organizations that will share in the proceeds, along with other youth-serving groups.

In the near future: River Days will be July 12 and 13. Flyers are currently being printed.
Finally, the Mayor congratulated Mr. and Mrs. Kevin Connors on the newest member of their family, Chase Addison, born on June 9 at 11:48 p.m. Big brother Brody is also delighted.
LAW DIRECTOR'S REPORT:
Mr. Bemer reported that all is going smoothly with the right-of-way legislation. AT&T has been in touch with Building Commissioner Beirne because it is moving ahead with construction of buildout boxes in some locations which are in private rights-of-way and are being constructed through private easements. The legislation, however, will address buffering of all potential locations.
The Charter Review Commission legislation is also moving forward. Mr. Bemer noted that the last of those ordinances, No. 77-08 dealing with Article X has been modified to eliminate naming Section 7 and instead using the language "the next available section". This change was made because it came to the City's attention that there are petitions outstanding for a citizens' referendum initiative for a potential Charter amendment which was submitted as Article X, Section 7. To avoid confusion, this section which deals with councilmanic ability to modify obsolete wording and grammatical errors, will be referenced as an available section when and if passed.
Discussion: Mr. Moran asked if there is an update on the property to be purchased next to the City Hall complex. Mr. Bemer said that the City has closed on the property ten days earlier. The Mayor added that partnerships are being discussed with Habitat for Humanity or A Piece of Cleveland for reclamation of materials before the house is razed. She said that, typically, parts such as doors, windows, lighting fixtures, etc. are not reused in their new construction. However, they have a store where individuals refurbishing older homes can often find particular moldings or fixtures which can be purchased to benefit the organizations.
COMMITTEE REPORTS:
Parks and Recreation Committee: Ms. Arabian indicated that the Commission had met last Wednesday and she reported that the Recreation Department is in full swing and extremely busy. For example, classes are full, and the adult indoor soccer league has 29 teams.
The City Hall playground is complete except for the preschool section that is waiting for funding from the Early Childhood PTA which will provide additional pieces.
Community Asset Building Coalition of Rocky River: In addition to the forum sponsored by Community Challenge, the Coalition heard an even more in-depth presentation by George "Pat" Willis in a four-hour workshop on Thursday afternoon. He gave excellent information and helpful ideas to help the Coalition help the community.
COMMUNICATIONS AND ANNOUNCEMENTS:
Ms. Arabian reported that the Greek Festival sponsored by St. Demetrios Church was a resounding success. Even with the rain, it was very well attended. It was a wonderful community event because it united residents of Rocky River and surrounding communities in a very positive activity.
Mr. Moran noted that because this is the fourth meeting of June, there will be no meeting next week. The next regularly scheduled Council meeting will be July 7.
Mr. Moran also asked about registration for the Antique Appraisal Fair and any deadlines. The Mayor responded that there is no registration for this event, but attendees are asked to limit their requests to two items. The Sunday of River Days will have a historic perspective: there will be guided historic tours sponsored by the Historical Society; there will be a Memory Lane Car Show and in the pavilion of the Ice Rink will be the Antique Appraisal Fair, coordinated by the library, which already has several appraisers ready to participate.

Discussion: At the last meeting, a series of changes were discussed which were relatively insubstantial. The title has also been amended to include an emergency provision because AT&T is ready to begin its construction and the City would like to have this legislation in place.

Discussion: Mr. Moran thanked members of the Commission for the many hours spent discussing Charter issues. He recognized Mrs. Bartolozzi, Mr. Thompson, Mr. O'Donnell, Mr. Lazzaro and Mr. Manoloff who were present, thanking them for coming this evening, and for all the hours spent in service to the City. He also thanked Mr. Bemer for his guidance and direction of the process, as well as Kate Straub for keeping Council up-to-date. Since members of the Commission were present, Mr. Moran indicated that he would move for a suspension of the three-read rule so that the resolution could be passed this evening.

Discussion: Mr. Shepherd commented that there was a great deal of talent on the Commission from all walks of life. He expressed appreciation for their time.
Mr. Bemer also thanked the members, noting that there was a very good mix from the community who worked well together, bringing up good concepts and future plans.
Ms. Arabian was pleased that so many people wanted to be involved, and she said they did a great job. She acknowledged the time commitment they made and thanked their families, too, for their support.
Mr. Furry echoed those thoughts, thanking them for the many hours they spent in their discussions.
The Mayor thanked Director Bemer and Mrs. Straub for their leadership, as well as all who spent countless hours in thoughtful and thorough review of issues. She also acknowledged their collaborative spirit, their teamwork and their practical approach, keeping in mind the realistic applications of the Charter and how it serves the community. She said she was looking forward to November, noting that members of the Commission would be interested to see what happens at the election.
Mr. Mylen also thanked members, commenting that he thought these were good recommendations and saying that he hoped they would be passed in November. He seconded Ms. Arabian's comments, noting that he appreciated their time, particularly in light of other commitments.

Discussion: Mr. Hunt indicated that the basis for the agreement with the ODOT is attached to the ordinance. This is the most competitive price for road salt, an estimated 5000 tons.
Mr. Linden added that the City usually uses 3500 to 4500 tons of salt per season. This contract provides that the City may purchase up to 150% of the estimate with a requirement for 50%. He said that applying now puts the City on the list for the state contract. Responding to Ms. Arabian's question, he said that the City used 4350 tons last year.

AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR AND THE SAFETY SERVICE DIRECTOR TO SELL USED CITY VEHICLES WHICH WERE PUBLICLY BID FOR A TOTAL SUM OF $14,580.00

As discussed at the last meeting of the Committee-of-the-Whole, Mr. Hunt noted that upon occasion, the Service Department has vehicles no longer needed for public purpose. Bids have been taken for seven such vehicles and he is ready to move forward. Proceeds will go to the General Fund except for one vehicle which will go to the WWTP.
ORDINANCE NO. 79-08 BY THOMAS J. HUNT
AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR AND THE SAFETY SERVICE DIRECTOR TO ENTER INTO AN AGREEMENT WITH LESLIE YARDMAIDS, FOR THE MAINTENANCE OF AN UNKNOWN NUMBER OF UNKEMPT PROPERTIES WITHIN THE CITY OF ROCKY RIVER FOR A PERIOD OF ONE (1) YEAR

This also was discussed at the last meeting, this ordinance will allow the City to engage a contractor to care for yards which need to be mowed because they are unsightly. The cost paid will be assessed to the property taxes.

AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR AND SAFETY SERVICE DIRECTOR TO ENTER INTO A CONTRACT WITH FABRIZI TRUCKING AND PAVING CO., INC. FOR THE 2008 PAVING PROGRAM IN AN AMOUNT NOT TO EXCEED $1,406,469.20

Mr. Hunt explained that this ordinance authorizes an annual program to repave streets which are in the greatest need of repair. Passage this evening will allow the project to proceed while the weather is cooperative.
