CITY OF ROCKY RIVER



OCTOBER 3, 2005





The Committee-of-the-Whole was called to order by Mr. Hurtuk, President Pro Tem of Council, at 8:00 p.m.

The meeting was opened with the Pledge of Allegiance. The meeting was being recorded by a resident.





MAYOR'S REPORT:



A resident pointed out an error in the latest issue of the newsletter. The correct date for the celebration of Halloween with "trick or treat" is Monday, October 31, not Sunday.



A change has occurred in the roster of regular members of the Design and Construction Board of Review. Because of his business workload, Charles McGettrick has resigned. This evening, the Mayor swore in Jill Brandt, an alternate, as a regular member. Ms. Brandt is a registered architect.



This Friday is Rocky River's homecoming at the high school, preceded by the homecoming parade beginning at the St. Chris parking lot. The parade route proceeds south on Northview, west on Westway, north on Wagar and east on Detroit to the high school.



A police auction has been scheduled for October 22 at 9:00 a.m. outside the police garage on the Hilliard Road side. Items for sale are those which have been confiscated or lost and not claimed, usually bikes and other miscellaneous items, as well as equipment no longer used by City Hall employees.



The 86-year old resident attacked in her home is out of the hospital. Mayor Knoble reported that when he spoke to her, she seemed to be very much better.



Finally, the Mayor reported that he has received a letter from Cox Cable announcing that four premium channels will be moved to the digital line-up to reduce cable theft.





UNFINISHED BUSINESS:



Ordinance No. 98-05: This ordinance prohibits storage of rubbish and garbage where it is visible from the public right-of-way. Mr. Potterfield indicated that discussions are ongoing regarding the wording because of his concern that the ordinance prohibits not only garbage containers, but other organic waste. He wondered if other Council members are concerned that grass clippings and branches could also be prohibited.



Mr. Potterfield will work on a proposed revision of wording, consulting with Mr. Beirne, the Building Commissioner, on the matter.





Ordinance No. 110-05 and 111-05: These two ordinances have also been reviewed by the Planning Commission, and Mr. Potterfield indicated that he is awaiting their approved minutes. The Planning Commission is scheduled to meet on October 18, so the minutes should be forwarded after that date.





Resolution No. 119-05: This resolution will allow the City to accept property from the State of Ohio which will be used as a park at the end of Bates Road. Three readings are necessary, and the resolution will have its third reading this week.





MISCELLANEOUS BUSINESS:

Mr. Hagan thanked the Mayor for preparing an informational flyer picturing the person indicted for sexual offenses against minors. The flyer was distributed over the weekend in the area where the offender lived as well as streets around the park. Mr. Hagan spoke to many residents who welcomed the information. Mayor Knoble thanked Councilman Hagan for distributing the flyers.



Mr. Hurtuk noted that the Peking House Restaurant has a new owner and a request for the transfer of their liquor license has been made.



COMMITTEE REPORTS:



Parks and Recreation Committee: This committee will hold a meeting next week at 7:00 p.m. in the David J. Cook Council Chambers to receive information about the proposed expansion of the Don Umerley Civic Center.





NEW BUSINESS:



Ordinance No. 129-05: This ordinance, and the one which follows, represent two easements, which although recorded by the County, were never accepted or recorded by the City. The easements would allow access to a 40' section of storm sewer, 15' from the property in this ordinance and 25' from the property in Ordinance No. 130-05. Without these easements, work on the storm sewer could not be done; Spencer Creek could not be kept open, and everyone south of Detroit Rd. would be flooded.

Ordinance No. 131-05: Mayor Knoble explained that Cold Harbor is our contractor for the family aquatic center, or outdoor pool. With all projects, certain things come up during the construction process. This is a settlement of all those issues as negotiated by Mr. Matty and our consulting engineer, who came in during the project.

As there was no further business by members of Council, the meeting was adjourned at 8:23 p.m.
