ORDINANCE NO. 112-07 BY THOMAS T. LONG
AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR AND THE DIRECTOR OF PUBLIC SAFETY SERVICE TO ENTER INTO A CONTRACT WITH BUILDING TECHNICIANS CORPORATION FOR THE CITY HALL PARTIAL ROOF REPLACEMENT PROJECT AT A COST NOT TO EXCEED $98,900.00

Moved by Mr. Long, seconded by Mr. Gollinger, that the rule requiring that Ordinance No. 112-07 be read on three separate days be suspended, and that Ordinance No. 112-07 be placed upon its passage:
Discussion: Mr. Long explained that this ordinance authorizes the partial replacement of the weakened portions of the flat roof of City Hall. Portions of the second floor have experienced water leakage so bids were sought, and three received. The lowest and best is outlined in the ordinance. Mr. Long commented that the ordinance should not be delayed to prevent further damage.

The Committee-of-the-Whole was called to order by Mr. Hagan, President of Council, at 8:05 p.m. following the Special Meeting.

MAYOR'S REPORT:
Mayor Bobst congratulated members of the Rocky River High School football team who won their first playoff game last Friday evening. They will play again on Friday at 7:30 p.m. at Lakewood Stadium.
The Mayor was pleased to report that the Don Umerley Civic Center is being well utilized by residents with five birthday parties held there last weekend. Already several events have been scheduled at the new facility.
Renovation of the clock tower is now complete. The Mayor commented that the carpenter and those assisting him from the Service Department did a wonderful job. The new weathervane, a gift of the Beach Cliff Garden Club, added the finishing touch, and many compliments have already been received on the project.
Council members have received information regarding the public records training. The Mayor observed that there is a requirement stated in the letter that "all elected officials or their appropriate designees" obtain the training. She noted that the session was very informative for those in elective offices.
Insurance proposals are being reviewed for the City, the WWTP and the Court. Those ordinances will be forwarded as soon as final selections have been made.
House Bill 24 and House Bill 224 are two bills which deal with municipal income tax. While they do not have dramatic impact at present, they could, potentially, if amendments should be added. H.B. 24 provides for a deduction for medical insurance and health savings accounts. Each municipality would be able to make its own decision on the deduction. There is interest in the Senate, however, in making that deduction mandatory. The Mayor will let Council members know of any developments. Details are also available in the Legislative Bulletin published by the Ohio Municipal League.
Leaf pickup is well under way. For the past few weeks, three passes have been made weekly throughout the community. That will slow with increased volume, but the program will continue until snowfall.
Grandview, the project on River Oaks, is progressing. The evaluation by the structural engineer will be sent to the Building Commissioner. There was community concern about mold in the project which has been delayed for some time, but the Mayor was pleased to report that there was limited mold partly because the structure is well ventilated and without windows. It will be sprayed, and the roof completed this week. The entire site has been regraded and improvements have been made to the sidewalks for greater safety.
The first residents will soon move back into Heritage House. The Mayor expressed pleasure to be able to welcome those residents back into the community.
Over the weekend, the hockey program raised close to $12,000 in a very well-attended and successful fundraiser.
There were more than 1000 attendees at the Senior Center's Quilt and Craft Show. Fifty-seven quilts were displayed and 33 vendors participated in the very successful event.
Next Monday is Veterans' Day and City Hall will be closed. The Council Meeting will be moved to Tuesday evening in recognition of the Monday holiday.
Tomorrow the polls open at 6:30 a.m. and will be open until 7:30 p.m. All candidates have received information via a third letter from the Safety-Service Director as well as the Law Director regarding signage at polling places. At the request of property owners, signage may not be planted on polling place properties, and the Board of Elections has a 100' rule. Signs may be held outside the 100' perimeter, but may not be planted on the property.
Discussion: Mr. Hagan reiterated that the Rocky River High School football team will play this Friday at Lakewood High School against the Lake Catholic Cougars at 7:30 p.m.
Mr. Moran noted that initially, half of Heritage House, the south side, will be tenanted. He commented that it will be great to see these residents back, after an absence of a year and a half, and that they, too, are very anxious to return.
UNFINISHED BUSINESS:
Ordinance No. 95-07: This ordinance, which regulates projecting and temporary business signs, has been referred to the Planning Commission which tabled it at their last meeting for further discussion at this month's meeting . Mr. Gollinger indicated that it will be on the agenda for this month's meeting.
Ordinance No. 100-07: Mr. Moran noted that this ordinance, which implements a right-of-way policy, was discussed at the last meeting. This week a revised draft has been issued by the Law Director and there will be further discussion at next week's meeting.
Resolution No. 101-07: Mr. Hagan explained that this resolution will authorize the Mayor and the City to participate in the ODOT Cooperative Purchase Program. As this is in the best interests of the City, Mr. Hagan will move for passage next week. (Consent Agenda)
Resolution No. 103-07: This is the tire ordinance which will permit the purchase of tires on the open market at the best price. Mr. Linden added that no tires from China will be purchased under this ordinance. (Consent Agenda)
Ordinance No. 104-07: This ordinance authorizes the purchase of gasoline, oil and allied products on the open market at the best price. (Consent Agenda)
Ordinances No. 105-07 through 111-07: Mr. Hunt noted that these ordinances were read for the first time at the last meeting, and indicated that the Administration has presented background material for these ordinances very succinctly. Superintendent Harrington has explained the need for the WWTP chemicals and services very well, noting that bids were opened on October 5.
Superintendent Harrington also indicated that, across the board, these ordinances represent an 8% to 12% increase over last year, based upon continuing higher fuel costs for the delivery and removal of these products and services. Council members with questions may call Mr. Hunt or Superintendent Harrington. (Consent Agenda)
MISCELLANEOUS BUSINESS:
Mr. Hagan noted that Council members had had an opportunity to review the request for a liquor permit submitted by The Pub on Detroit Road. There was no discussion nor objections from members of Council.
COMMITTEE REPORTS: NONE
NEW BUSINESS:
Ordinance No.112-07: This ordinance was passed at the Special Meeting prior to this meeting.
Resolution No. 113-07: Mr. Moran reported that this resolution will authorize an application for the grant discussed at the last meeting which will provide additional funding for safety enhancements for the Lake Road project. The application will be for $100,000 and is due shortly. (Consent Agenda)
Resolution No. 114-07: Mr. Hurtuk explained that increased traffic at the Civic Center because of the fitness center and the aquatic center has created a problem with petty cash. An increase is required in the petty cash available so that cashiers can readily make change. The current maximum is $1500; the increase would raise this to $2000. Mr. Hurtuk has spoken with both Director Thomas and Director Patterson and indicated that the request seems reasonable. (Consent Agenda)
Ordinance No. 115-07: This ordinance renews the health contract with the General Health District of Cuyahoga County for 2008. Mr. Hagan turned to the Mayor for her comments. The Mayor indicated that this annual contract is a cost-effective way to provide many services to the community, including everything from immunization, early childhood intervention, lead poisoning prevention, restaurant assessments and community assessments among many others. The Mayor said that the depth and breadth of the services provided is incredible, and very cost effective. Responding to Mr. Hagan's question, she noted that the fee is the same as last year, but it was raised two years ago. (Consent Agenda)
Mr. Hagan urged everyone to exercise the right to vote tomorrow. He also reminded everyone that the next meeting will be on Tuesday, November 13.
As there was no further business by members of Council, the meeting was adjourned at 8:25 p.m.
